The Legal Landscape

  • National law — the Public Gambling Act of 1867 still governs physical premises. It pre-dates the internet by over a century and says nothing about online play.
  • State authority — gambling law is largely a state subject. Goa, Daman, and Sikkim run licensed physical casinos; Sikkim has made tentative moves toward regulated online play. Most states have no online-specific legislation at all.
  • Offshore access — sites holding Curacao or Anjouan licences are based outside India and accessible to Indian players without breaching Indian law as it's currently read.
  • No domestic consumer protection — disputes get handled under the operator's licensing jurisdiction, not in Indian courts. You're outside the umbrella of Indian consumer law.
  • State-specific bans — Telangana and Andhra Pradesh have explicit prohibitions on any form of online gambling. Players resident in those states carry materially more legal exposure than the rest of the country.

What This Means for You

For most Indian players outside the explicitly prohibitive states, the practical reality is: you can sign up at offshore-licensed operators without violating any specific law, but you're responsible for understanding your state's position and any tax implications on winnings. Always read the terms at any operator before depositing — and avoid sites without a verifiable licence.

Tax Considerations

Gambling winnings in India are subject to income tax. The current TDS rate on winnings from online gaming is 30% under section 115BBJ of the Income Tax Act (introduced via the 2023 amendments). Operators may or may not deduct tax at source — this varies by jurisdiction. Keep records of significant wins for self-assessment.
